DC AG Drops KKK Act Suit Against Proud Boys, Oath Keepers Amid Resource Shift

The District of Columbia Attorney General’s office recently dropped a civil lawsuit against the Proud Boys and Oath Keepers, two groups tied to the January 6, 2021, Capitol attack. Filed in December 2021 under the Ku Klux Klan Act of 1871, the case aimed to hold these organizations accountable for their alleged involvement in the chaos that day. The decision to dismiss, announced on March 17, 2025, came down to practical concerns: limited law enforcement resources and the small financial payouts the suit might’ve yielded.

Back when it was launched by then-Attorney General Karl A. Racine, this lawsuit was a big deal—the first time a government entity took civil action against these groups over January 6. It sought money to cover police overtime, medical bills for injured officers, and support for those left shaken by the event. Using the Ku Klux Klan Act, a law originally designed to tackle hate group conspiracies, showed how seriously the District viewed the accusations.

So, why drop it? Current Attorney General Brian Schwalb’s team decided the effort wasn’t worth it—not when resources are tight and the potential rewards were slim. Some folks agree it’s a smart shift to focus on pressing local needs; others argue it lets these groups off the hook too easily. Meanwhile, criminal cases against individual members, like Proud Boys leader Enrique Tarrio—who got 22 years before a pardon from President Trump on January 20, 2025—keep rolling forward, raising questions about how accountability really works here.

This dismissal highlights the challenge of using old laws to tackle today’s issues, especially with stretched budgets. It’s a tough call, and it leaves plenty of debate about justice and responsibility in the air.
